Office Lease and Commercial Lease

Office lease and commercial lease (real estate)

Renting or leasing commercial premises and office space is usually regulated by legal provisions. Therefore, it is essential to have contracts and agreements drafted in a clear manner, minimising the occurrence of later problems and misunderstandings. GMW Advocaten is happy to lead the way...

As a first step, make sure you know whether you are renting office space or commercial space, since legal provision regulating their lease differ quite substantially; especially provisions concerning lease terms and installments, cancellation of the lease, increase of the rent and substitution.

Changing the rent

In the case of commercial premises, the lessor and the lessee can agree on periodic changes of the rent. Disputes resulting from these situations are tricky and can lead to lengthy legal procedures. Therefore it is wise to consult a lawyer before signing a lease.

Substitution of the lessee

Lessees of commercial premises can bring in a substitute lessee to the premises rented in case they wish to terminate their commercial activity in that particular place. However, they must comply with certain provisions, in order to be allowed to do so. How can one enforce the substitution, as a lessee; how can a lessor protect his interests in case of this Changing of the Guard? The specialised lawyers  at GMW Advocaten can bring in their expertise both in the preliminary phase of negotiations, as well as in ensuing court procedures.

Breech of contract by the lessee

Quite often, the lessor is confronted with breach of contract by the lessee; for instance with overdue payments, subletting without the consent of the lessor and growing hemp. In such cases one is well advised to act swiftly. GMW Advocaten has represented lessors over the years in cases implying settlement of rent arrears, dissolving a lease or eviction of the rented premises.
