Mediation is a very flexible process requiring three things only; confidentiality, voluntary attendance and dedication. The mediator is a neutral person, facilitating the process by unlocking unproductive thinking patterns, motivating the parties to consider all aspects of a situation by helping them envision a future rather than getting stuck in the past. Mediation begins with signing an agreement that explains the rules and stages of the process. It stipulates the principles of voluntary participation, confidentiality and good will, making it evident that nothing of what is said in mediation can be used in court. It also informs the parties of their right to seek a second opinion, should they feel uncertain or uncomfortable with the course the mediation process is taking. The results and conclusions of the mediation will be incorporated into an agreement. Once both parties have signed, the document becomes a binding and public legal document.
