Publication Marjet van Yperen in Dutch Family law journal
The latest issue of “EchtscheidingsBulletin”, a renowned Dutch Family law journal, features an article about the field of application of the so-called “Trema rapport” by Marjet van Yperen – Groenleer, GMW Advocaten. In the Netherlands, alimony calculations are made on the basis of these Trema rules. Marjet wonders whether it is reasonable to apply them in all divorce cases. How to determine, for instance, the children’s needs in high income (millionaires) divorce cases? And what about cases with an international character, when one of the spouses lives abroad? How will the financial capacity of the soon to be ex husband be calculated if he is not or only partly subject to the Dutch tax system? Will it be taken into account that life in the country he lives in is more expensive or cheaper than in the Netherlands? How to deal with the different allowances and reimbursements of expats? And what is the (ex) wife’s need if she leads an expat life and gave up her career? Marjet elaborates on these issues in her article.
