Matrimonial home

Decisions involving the matrimonial home following a divorce have both financial and emotional implications. Such decisions must be carefully considered, as they can have far-reaching implications. GMW Advocaten can advise you on the legal and fiscal aspects of your options.
Thoughts concerning the matrimonial home are possibly among the first worries after taking the decision to get divorced. Who will have the right to remain in the home? How will the mortgage be paid as long as the divorce is not completed? Can maintenance obligations be compensated with a portion of the excess value?

Clear arrangements/agreements

GMW Advocaten will explore all options for clear and stringent agreements/arrangements with regard to the use of the matrimonial home during and after the divorce, aiming for amicable solutions. Should the domestic situation become untenable we will ask in court for a ‘temporary order’, a measure valid for the duration of the divorce proceedings. Upon request, the Court can also grant other temporary orders, for e.g. temporary maintenance or a temporary domicile for the children.
