Pension rights

After the first emotional waves will have smoothened, you might ask yourself what the fate of accrued pension rights following a divorce might be. Do they have to be divided equally? Can a different percentage for the splitting of pension rights be negotiated?
In principle, each of the partners is entitled to half of the pension rights accrued by the other partner during the marriage (pension equalisation) The surviving dependant’s pension will be reserved as a non-contributory pension (premievrij gereserveert), and you will be paid a special surviving dependant’s pension, should your ex-partner pass away. This may sound quite simple, however, it is often worthwhile to investigate more advantageous solutions. Sometimes it will be possible to convert the other partner’s pension rights into an old age pension in your own name, a preferred solution when the age difference between the spouses is considerable.

Surviving dependant’s pension

Whenever the surviving dependant’s pension was accrued on a risk base, the ex partner loses his or her entitlement to it following a divorce. Both maintenance as well as the surviving dependant’s pension will terminate. Thus, other measures must be taken.
