Project development

Large-scale real estate development projects imply complex ties between the partners involved. At times, things will go wrong and it will be best to take legal advice in order to bring matters back to normal. GMW Advocaten can do both; scan existing agreements and advise clients on their rights and duties in a dispute situation; and help clients in drafting contracts that will settle matters the right way from the very beginning.

The co-operation between construction companies, building partners, financers, investors, administrators and governmental agencies requires adequate forms of agreements. Written contracts are best to clearly stipulate the rights and duties of each party within the process. GMW Advocaten will check existing contracts for ambiguities and flaws, also assisting clients in drafting contracts that serve their interests best. Practice shows that even thorough contracts can lead to disputes; in big projects it is difficult to clearly separate the responsibilities of the commissioning client from those of the contractor.GMW Advocaten will help evaluate the rights and risks of a disputed situation, also assisting clients in court, if need be.

Our role

GMW Advocaten is well acquainted with the ins-and-outs of the real estate sector, the corporations and the different governmental authorities, having also relevant experience with public – private partnerships and all kinds of different ‘design and build’ contracts. Licences, regulations, expropriations and environmental requirements are part of what we deal with on a daily basis. Consult GMW Advocaten for a good head start in that one-of –a-kind project or to settle a dispute  - we’ll work out several options, giving you an estimate of the risks and costs involved. Be it in mediation or in court you will be assisted all the way by experts in the field.
