Tenancy law

Signing a lease is easy. However, knowing for certain what one signs for can sometimes be a bit more intricate. Especially expats might ask themselves every now and then whether the provisions in their leases are fair or reflect what is customary on the rental market.

Sometimes landlords and lessees get into a deadlock situation over keeping pets or the refund of deposits. GMW Advocaten can help minimise unpleasant surprises by checking leases and mediating between the parties, in case of a dispute.

Lessee

Once you have found the home of your dreams you will most probably receive a draft of the lease, stipulating the minimal rental period, the monthly amount due, the address and other provisions. It might even happen that the lease is drafted in Dutch, the finesses of the legal lingo being beyond your everyday conversation skills.
GMW Advocaten can quickly check whether your contract is a fair one or whether the conditions imposed are solely protecting the landlord’s interests.

Disputes

It may happen that your landlord refuses to repair a leakage, or a broken central heating. Are you entitled to stop paying rent? Is it all right to call in a handyman yourself and deduct the repair costs cost of the repairs from the rent until the problem gets resolved? Call GMW Advocaten  - they will advise you in a free phone consultation without obligation on your rights as a lessee and the ways to have them enforced.

Lessors

You have decided to rent out your property. Are you aware of the differences in legal implications between unlimited or limited rental periods? Is it wise to have the lessee register his or her domicile at the address of your property? Are you aware of the responsibilities that you assume as a lessor? It is very important to get things right from the beginning in order to minimise damages in future disputes. Please call us for a scan of your rental contract draft.

Disputes with lessees

Lessees who delay their rent payments or try to find ways not to pay their dues at all are more than just a nuisance. They sometimes use residential purposes to grow hemp or they sublet without the owner’s agreement. GMW Advocaten has represented lessors and lessees over the years in cases implying settlement of rent arrears, dissolving a lease or eviction of the rented premises.
