Bankruptcy Camptoo-Groep

By Stephanie de Wit

On 26 October 2022, the District Court of The Hague converted the moratorium of Deelit Ventures B.V., Deelit Ventures IP B.V. and Camptoo NL B.V. into bankruptcy.

These companies are part of the Camptoo group.

Camptoo NL houses the Dutch commercial activities of the Camptoo group. Mr S.M. de Wit (GMW advocaten in The Hague) has been appointed trustee by the court.

Important to note is that the activities do continue solely in Australia, Denmark and the UK. Please visit the respective websites in case you want to continue to use the Camptoo services.

‘Please note’
Renters and owners who decide by mutual agreement to proceed with future bookings from today should note that Victor insurance Europe B.V. / Marsh and Allianz will no longer provide insurance cover and breakdown assistance from 27 October 2022 at 00.00 hours. You will have to arrange for other insurance yourself. Victor insurance Europe B.V. / Marsh and Allianz are not available.

If the rental period of the motor home or caravan commenced before 27 October 2022 at 00.00 hours and the motor home or caravan was also made available to the renter by the rental company before 27 October 2022 at 00.00 hours, the insurance and roadside assistance – insofar as this has been taken out with Victor insurance Europe B.V. / Marsh and Allianz – will be paid out during the contractual rental period and the motor home or caravan will be insured during the rental period. You can hit the road with peace of mind.

Activities ceased

Because Camptoo NL B.V. can no longer meet its financial obligations, on the afternoon of 25 October 2022 the trustee was forced to cease operations with immediate effect within Camptoo NL. Camptoo NL can no longer guarantee compliance with the rental agreements.

This has possible consequences for both renters and owners.

Renter of a campervan or caravan

1. Have you booked a campervan or caravan and are currently travelling with it?

There is a rental agreement between the renter and the owner. Camptoo NL has mediated in the conclusion of the agreement and has received the rental payments from the renter as well as the deposit paid by the renter. They are not in a position to pass on the prepaid rent to the owner. Camptoo NL is also not in a position to refund the deposit paid by the renter.

As a result, the trustee can imagine that the unpaid owner wishes to receive his campervan back as soon as possible. We suggest you consider contacting the owner directly to make mutual arrangements. Camptoo NL has nothing further to do with this.

Insofar as a daily insurance for the campervan has been taken out via Camptoo NL, the insurers have agreed that the insurance will be extended until the end of your rental period. The rented vehicle is still insured during the rental period.

2. Have you booked a campervan or caravan and the rental period has not yet started or you have not yet received it from the owner?

There is a rental agreement between the renter and the owner. Camptoo NL has mediated the conclusion of the agreement and has received the rental payments from the renter as well as the deposit paid by the renter. They are not in a position to pass on the prepaid rent to the owner. Camptoo NL is also not in a position to refund the deposit paid by the renter.

Because of this, the trustee can imagine that the owner is no longer willing to make the campervan or caravan available to you.

Insofar as Victor Insurance Europe B.V. took out daytime insurance for the campervan when you booked via Camptoo NL, if the owner of the campervan does make it available to you, the campervan will not be insured. The insurance does not cover campervans in a rental period from 27 October 2022 from 0.00 onwards. There will also be no breakdown cover through the Allianz insurance from then on. For this reason, the trustee will strongly advise the owner not to make the campervan available without insurance.

The renter and owner are free to make arrangements outside Camptoo NL to rent the campervan or caravan. Please ensure that the campervan or caravan is insured during the rental period. In this case, you must arrange your own insurance, which cannot be arranged with Victor Insurance Europe B.V.; in many cases you can, for example, with NKC.

Owner of a campervan or caravan?

1. Have you rented out a campervan or caravan and the renter is already on the road with the campervan or caravan?

There is a rental agreement between the renter and the owner. Camptoo NL has mediated in the conclusion of the agreement and has received the rental payments from the renter as well as the deposit paid by the renter. They are not in a position to pass on the prepaid rent to the owner. Camptoo NL is also not in a position to refund the deposit paid by the renter.

If you have currently made your campervan available to a renter, it is between you and the renter whether or not to agree on any early termination of the rental. Camptoo NL is not involved in this. Please note, however, that although the renter has paid the rent, it can unfortunately no longer be passed on to you by Camptoo.

Insofar as a daily insurance for the campervan has been taken out through Camptoo NL, the insurers have agreed that the insurance will be paid out until the end of your rental period. The rented vehicle is still insured during the rental period.

2. Have you rented out a campervan or caravan, but the rental period has not yet started and/or it has not yet been made available?

There is a rental agreement between the renter and the owner. Camptoo NL has mediated the conclusion of the agreement and has received the rental payments from the renter as well as the deposit paid by the renter. They are not in a position to pass on the prepaid rent to the owner. Camptoo NL is also not in a position to refund the deposit paid by the renter.

Because of this, the trustee can imagine, that you as the owner are no longer willing to make the campervan or caravan available to the renter. In addition, if Victor Insurance Europe B.V. took out daily insurance for the campervan when you booked via Camptoo NL, the campervan will not be insured if you do make it available to the renter. Nor will breakdown assistance via Allianz insurance be available from that moment on. The insurance does not cover campervans in a rental period from 27 October 2022 from 00.00 hours. For this reason, the trustee advises you not to make the campervan available without insurance.

The renter and owner are free to make arrangements outside Camptoo NL for any rental of the campervan or caravan. Please ensure that the campervan or caravan is insured during the rental period. In this case, you must arrange your own insurance, which cannot be arranged with Victor Insurance Europe B.V.; in most cases you can, for example, with NKC.

Creditors of Camptoo NL B.V.

Due to the bankruptcy, unfortunately no further payment of rental fees owed by Camptoo NL will be able to be made to owners. Rents paid in advance by renters and deposits paid by renters cannot be refunded either.

You can submit a claim to the trustee . This can be done via the e-mail address faillissementen@gmw.nl. At the moment, it is not known whether there might be a distribution to creditors.

Do you have any questions?

The trustee is currently focusing mainly on realising a possible relaunch of the company. As soon as more is known about this, it will be shared with you via the gmw.nl website.

There will be periodic reports on the progress of the moratorium. You can access these reports here.

Do you have any urgent questions? If so, please contact:

  • M.M.E. van Veen-Oudenaarden
