Bankruptcy Camptoo Group: damage to campervan or caravan

The trustee receives many questions about damage to caravans and campervans. If you are a lessor and your tenant has caused damage to your campervan  or caravan, or if are you a tenant and you have caused damage to the rented campervan  or caravan, then please read this article carefully.

1. Own risk

An own risk applies to every damage claim.

This means that – if there is insurance – the insurance will only cover the damage that exceeds the own risk.

Previously, Camptoo deducted the own risk from the deposit paid by the renter to Camptoo. Camptoo then paid out this part of the deposit to the lessor, instead of Camptoo refunding the entire deposit to the tenant.

Unfortunately, because of the bankruptcy, the trustee can no longer pass on the deposit paid by the tenant to Camptoo to the lessor.

What can you do?

  • As a lessor, you can file a claim in the bankruptcy, to the amount of the own risk that Camptoo should have paid to you.

You can file a claim in bankruptcy by sending an email to faillissementen@gmw.nl, clearly stating (1) the amount of the own risk that should have been deducted from the deposit, and (2) substantiating the claim with documents (such as the damage report).

2. Redemption of own risk with Rental Cover.

In some cases tenants have bought off the own risk through insurance with Rental Cover. In that case, for example, the renter paid only € 250 in own risk instead of €1,000. The difference of € 750,– was then covered by Rental Cover.

This was done as follows. The above example amounts are kept for illustrative purposes.

Camptoo deducted the own risk of €250 from the deposit paid by the renter to Camptoo, and passed this amount on to the lessor.

In addition, Camptoo forwarded the damage report to Rental Cover, with a request to pay the remainder of the damage (as far as the redemption of own risk is concerned), in the example €750. After Rental Cover approved this request, Rental Cover paid this amount to Camptoo. Camptoo then paid this amount on to the lessor.

In some cases, Rental Cover has already paid the remainder of the damage to Camptoo. However Camptoo has not yet passed this amount on to the lessor. Due to the bankruptcy, the trustee unfortunately can no longer pass on the amounts received from Rental Cover to the lessor.

In other cases, Rental Cover still has to pay the own risk, or the damage may even have to be reported.

Because of the bankruptcy, Rental Cover will have to pay the deductible payments directly to the lessors. Rental Cover will also have to handle new claims reports itself. Camptoo / the trustee can no longer continue to pay the deductibles and can no longer collect or transmit claim data (for new claims) to Rental Cover.

What can you do?

  • As a lessor, you can file a claim in the bankruptcy to the amount of the deductible paid by the tenant that Camptoo should have passed on to you (the €250 in the example).*
  • Did you already report your damage some time ago, and would you like to know whether Rental Cover has already paid the deductible to Camptoo or not? Please send your question to claims@rentalcover.com.
  • Does it eventually turn out that Rental Cover has already paid out the deductible to Camptoo? Then the receiver will not be able to pass this amount on to you as indicated. You as a lessor can also file a claim in the bankruptcy to the amount of the deductible that Rental Cover has paid to Camptoo (the €750 in the example).*
  • Haven’t reported your claim yet? Then follow the step-by-step plan below.

To submit a claim to Rental Cover, send an email to claims@rentalcover.com with the following information:

Subject: Reservation number

  1. INS (the policy reference ID associated with each policy/booking. E.g. JQS8-CH54-INS):
  2. Booking number:
  3. Full name:
  4. E-mail address:
  5. What happened? Provide as many details as possible about the damage and the cause.
  6. What was the date & time of the incident?
  7. What is the total amount you are claiming?
  8. Tenant’s own risk:

In doing so, you should also attach a copy of the following documents:

  1. The booking agreement
  2. The repair invoice (if repairs have been quoted or completed).
  3. A bank or credit card statement as proof of payment for the damage.
  4. Attach any photos of the damage to the vehicle.
  5. Attach a copy of the vehicle transfer form.

*You can file a claim in bankruptcy by sending an email to faillissementen@gmw.nl, clearly stating (1) the amount of the own risk that should have been offset against the deposit, and (2) substantiating the claim with documents (such as the damage report).

3. Day insurance with Victor Insurance B.V. / Marsh

As also previously published, the following applies with respect to day insurance at Victor Insurance B.V. / Marsh:

“If the rental period of the campervan  or caravan commenced before October 27, 2022 at 00.00 a.m. and the campervan or caravan was also made available to the renter by the lessor before October 27, 2022 at 00.00 a.m., then the insurance and breakdown cover – insofar as this has been taken out with Victor insurance Europe B.V. / Marsh and Allianz – will be paid out during the contractual rental period and the campervan  and or caravan will be insured during the rental period. You can cross the road with peace of mind.”

We also ask you to request a quotation from a repairer and to provide us with the expected damage amount. In addition, we request that you complete the European Claims Form digitally.”

4. Disputes between tenant and landlord

In disputes between tenants and landlords among themselves, the trustee unfortunately cannot take a position. The trustee can only report that, if parties suffer damages as a result of Camptoo NL B.V. and/or Deelit Venture B.V.’s failure to fulfill its payment obligations, they can file a claim in the bankruptcy.
